 TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the Ski Connect platform and services. By creating an account, accessing the platform, or using the services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use Ski Connect.

1. About Ski Connect

 

Ski Connect is an online platform that allows individuals seeking ski or snowboard instruction (“Clients”) to connect with independent instructors (“Instructors”).

​

Ski Connect:

  • provides a digital platform for discovery and communication;

  • allows Instructors to create profiles and receive contact requests from Clients; and

  • facilitates introductions between Clients and Instructors.

 

Ski Connect does not provide ski instruction services and is not a party to any agreement formed between Clients and Instructors.

Any lesson, instruction, activity, booking, or payment arrangement is solely between the Client and the Instructor.

2. Independent Instructors

 

All Instructors using Ski Connect operate as independent service providers.

Ski Connect:

  • does not employ Instructors;

  • does not supervise lessons;

  • does not control how instruction is delivered; and

  • does not guarantee the quality, safety, legality, or suitability of any instruction or services offered by an Instructor.

 

Clients are responsible for conducting their own assessment of an Instructor’s suitability.

3. Platform Role and Limitations

Ski Connect acts solely as a technology platform facilitating introductions.

Ski Connect does not:

  • organise or manage lessons;

  • set instructor pricing;

  • collect payments for lessons (unless expressly stated);

  • provide equipment or safety supervision;

  • verify instructor qualifications beyond information provided by the instructor.

 

Users acknowledge that Ski Connect cannot guarantee the accuracy of instructor profiles, reviews, qualifications, or representations.

4. User Accounts

To use certain features of the platform, you must create an account.

You agree that:

  • the information you provide is accurate and current;

  • you will maintain the confidentiality of your login credentials;

  • you are responsible for all activity occurring under your account.

 

Ski Connect reserves the right to suspend or terminate accounts that provide false information or misuse the platform.

5. Instructor Responsibilities

Instructors using Ski Connect agree that they:

  • are responsible for complying with all applicable laws and resort regulations;

  • hold any required certifications or licences to provide instruction;

  • maintain appropriate insurance where required;

  • are responsible for the safety and conduct of their clients during instruction.

 

Ski Connect may remove Instructor profiles that breach these requirements.

6. Client Responsibilities

 

Clients acknowledge that:

  • skiing and snowboarding involve inherent risks, including the risk of injury;

  • they participate in lessons and mountain activities at their own risk;

  • they are responsible for assessing the suitability of any instructor they choose to engage.

 

Clients must follow all safety instructions provided by their instructor and the relevant resort.

7. Assumption of Risk

 

By using Ski Connect to locate an Instructor, Clients acknowledge and accept that:

  • skiing, snowboarding, and mountain sports involve inherent physical risks;

  • injuries, accidents, or incidents may occur during instruction or related activities.

 

To the maximum extent permitted by law, Ski Connect does not accept responsibility for injuries, losses, or damages arising from activities arranged between Clients and Instructors.

8. Disputes Between Users

 

Any agreement for instruction or services is made directly between the Client and the Instructor.

Ski Connect is not responsible for resolving disputes between users.

If a dispute arises, the Client and Instructor must resolve the matter directly between themselves.

Ski Connect may, at its discretion, remove accounts or profiles associated with serious complaints.

9. Disclaimer of Warranties

 

The Ski Connect platform is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Ski Connect makes no warranties regarding:

  • the availability or reliability of the platform;

  • the quality or suitability of any instructor;

  • the accuracy of information posted by users.

 

Users access and use the platform at their own risk.

10. Limitation of Liability

 

To the maximum extent permitted by law:

Ski Connect’s total liability to any user for any claim arising from use of the platform is limited to:

  • the total amount paid by that user to Ski Connect in the 12 months preceding the claim, or

  • AUD $100 if no fees were paid.

Ski Connect will not be liable for:

  • indirect or consequential losses;

  • loss of income, profit, or business opportunity;

  • personal injury or damage arising from activities arranged between users.

Limitation of liability clauses are widely used in online platforms to cap financial exposure and manage risk.

Nothing in these Terms excludes liability where it cannot legally be excluded under applicable law.

11. Indemnity

 

You agree to indemnify and hold harmless Ski Connect from any claims, damages, losses, or expenses arising from:

  • your use of the platform;

  • your breach of these Terms;

  • any agreement or activity between you and another user.

12. Platform Availability

 

Ski Connect may modify, suspend, or discontinue the platform or any feature at any time.

We do not guarantee uninterrupted access to the platform.

13. Intellectual Property

 

All intellectual property rights in the Ski Connect platform, branding, and content belong to Ski Connect.

Users may not copy, reproduce, or distribute any part of the platform without permission.

14. Termination

 

Ski Connect may suspend or terminate your account if you:

  • breach these Terms;

  • misuse the platform;

  • engage in unlawful or harmful conduct.

Users may close their account at any time.

​

15. Changes to These Terms

 

Ski Connect may update these Terms from time to time.

Where changes are significant, users may be required to accept the updated Terms before continuing to use the platform.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any disputes arising from these Terms will be subject to the jurisdiction of the courts of Queensland.

17. No Endorsement

 

The appearance of an Instructor profile, listing, review, or rating on the Ski Connect platform does not constitute an endorsement, recommendation, or guarantee by Ski Connect.

Ski Connect does not verify, guarantee, or warrant the qualifications, experience, licensing, insurance, or suitability of any Instructor beyond the information provided by that Instructor.

Any reviews, ratings, or profile information are provided by users and reflect the opinions of those users only.

Clients are responsible for conducting their own assessment of an Instructor before engaging their services.

18. User Conduct

 

Users of the Ski Connect platform agree to use the platform responsibly and lawfully.

You must not:

  • provide false, misleading, or inaccurate information;

  • impersonate another person or misrepresent your identity or qualifications;

  • use the platform for unlawful purposes;

  • harass, threaten, abuse, or harm other users;

  • upload or transmit content that is defamatory, offensive, or illegal;

  • interfere with the operation or security of the platform.

 

Ski Connect reserves the right to suspend or terminate accounts that breach these rules or misuse the platform.
